General terms and conditions

    1. Basic provisions
      1. The following General Terms and Conditions are the basis for a fair customer relationship and apply to all business relationships that you as a consumer enter into with Cosmetic Cell Concept GmbH (supplier).
      2. A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
        An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.
      3. We supply our products exclusively to consumers in household quantities for home or private use. You agree not to purchase our products for commercial or resale purposes. We expressly disclaim any liability for any resulting damages (loss of business, loss of profit, etc.).
      4. Our website contains information about products. All product information is for illustrative purposes and is not binding. The information has been compiled and checked with due care. We decline any liability for topicality, correctness and completeness. The information on our website is for general information purposes and in particular does not represent any assurance or guarantee of product characteristics. The product information on our website is not a substitute for professional or medical advice.
    2. Scope
      1. The entire Cosmetic Cell Concept offer is aimed at customers within Switzerland.
    3. Conclusion of the contract
      1. The subject of the contract is the sale of (physical) cosmetic products.
      2. The presentation of the products on our website does not constitute a legally binding offer, but is to be understood as a non-binding product offer. Our assortment is subject to change, which is why we cannot guarantee complete availability of our products.
      3. By sending the order, the customer submits a binding offer to us to conclude a purchase contract. We reserve the right to reject this binding offer. We accept the contract by delivering the goods.
      4. If your ordered product is not in stock or out of stock, we will inform you about it. In this case, we will reduce your order to the deliverable products and refrain from accepting the contract regarding the non-deliverable products. If you have already paid the purchase price for a product that is not available, we will refund it to you as soon as possible.
      5. You can add products to the shopping cart without obligation. You can make corrections at any time before submitting the order, for example by clicking the “x” button in the shopping cart.
      6. The order process can be canceled at any time until the order is sent, for example by closing the Internet browser.
      7. A binding order for the products contained in the shopping cart is concluded by clicking the button “Order subject to payment”. Withdrawal from the contract is excluded from this point on.
      8. Assuming a valid or active e-mail address, you will receive an automated confirmation of receipt of your order, including a summary of the essential contractual content, by e-mail immediately after sending your order.
    4. Prices
      1. All prices are in Swiss francs (CHF).
      2. The product prices shown in our range include the statutory value added tax.
      3. We will charge you an additional postage fee of CHF 6 for shipping costs.
    5. Payment
      1. We only accept the payment methods displayed in each case as part of the ordering process (instant payment systems). Payment processing is done through our partner “Stripe”.
      2. For all available payment methods we do not charge any additional costs.
    6. Retention of title
      1. The goods shall remain the property of Cosmetic Cell Concept GmbH until payment has been made in full.
    7. Delivery conditions
      1. For shipping we cooperate with the Swiss Post. Delivery is made exclusively to addresses in Switzerland. The transfer of risk takes place when the shipment is handed over to the carrier.
      2. Our products are usually shipped within 5 (five) business days from the receipt of the order to the address specified by the customer in the order.
      3. Despite our best efforts, we cannot rule out delays due to high order intake.
      4. If products are delivered to you as a consumer with transport damage, we recommend that you contact the carrier immediately and make a complaint.
    8. Return and warranty
      1. A return and exchange of products is generally excluded.
      2. We vouch for defects within the scope of the statutory warranty obligation.
      3. For consumers, the statutory warranty period is 2 (two) years from delivery of the goods.
      4. The buyer has the obligation to inspect the goods immediately after receipt, at the latest within 7 (seven) days, for the presence of any defects, otherwise the goods shall be deemed approved. In any case, the duty to examine and to give notice of defects shall apply. Cosmetic Cell Concept must be notified immediately of any defect. Cosmetic Cell Concept shall be entitled to exchange the defective product for a non-defective product. Only if a replacement of the product is not possible, the customer is entitled to a reduction or refund of the purchase price.
      5. In the event of a replacement delivery of the product or refund of the purchase price, all defective products delivered must be returned to Cosmetic Cell Concept.
    9. Liability
      1. Our products and their raw materials are produced and tested according to the current European guidelines (KVO and GMP). Animal testing is completely dispensed with. In any case, before use, please refer to the specific product information, in particular the information on the ingredients contained in the product as well as on the recommended use, on the product packaging. We accept no liability for any handling and/or application deviating from this. Likewise, we assume no liability for an individual incompatibility of our products.
      2. Liability for any indirect damages and consequential damages is excluded in full.
      3. Liability for direct damages is limited to the purchase price paid by the customer. This limitation of liability shall not apply in cases of intent and gross negligence, fraudulent concealment of a defect, injury to life, health and body and in the mandatory cases covered by the application of the Product Liability Act.
      4. Any liability for auxiliary persons or vicarious agents is excluded in full.
      5. The Customer is obliged to report any damage to Cosmetic Cell Concept immediately.
      6. According to the current state of the art, data communication cannot be guaranteed to be error-free and/or available at all times. We are not liable for the uninterrupted or continuous availability of our website and exclude any liability (including negligence).
    10. Force majeure
      1. If the fulfillment of our contractual obligations is delayed or prevented due to force majeure, we will inform you as soon as possible.
      2. In such cases, we will fulfill our obligations as soon as we are able to do so again.
      3. We cannot accept liability for losses incurred by you in cases of force majeure.
    11. Privacy
      1. We refer to the provisions in our Privacy Policy.
    12. Intellectual property and copyrights
      1. As the operator of this website, Cosmetic Cell Concept is also its owner.
      2. All trademarks, names, logos, designs, texts and other materials used on our website are the property of Cosmetic Cell Concept GmbH or its contractual partners.
      3. No rights (copyrights, industrial property rights, etc.) are acquired by calling up, downloading or copying information and pages or by purchasing products.
      4. The use of our website or the information and materials contained therein is prohibited without prior written consent.
    13. Amendments and defense clause
      1. We reserve the right to change our Terms and Conditions at any time and without notice, if necessary. The General Terms and Conditions shall apply in the respective version current at the time of the conclusion of the contract.
      2. If, as an entrepreneur, you use conflicting or supplementary terms and conditions, these shall only become part of the contract if we have expressly agreed to them.
    14. Severability clause
      1. Should one or more provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions of these General Terms and Conditions. The invalid provision shall be replaced by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision. The same applies to any gaps.
    15. Applicable law and place of jurisdiction
      1. These General Terms and Conditions are governed exclusively by Swiss substantive law. Insofar as no mandatory statutory provisions take precedence, the court with subject-matter jurisdiction at the registered office of Cosmetic Cell Concept GmbH shall have jurisdiction.
